Please read the general terms and conditions of sale before confirming your order!


1. Scope of Application

These general terms and conditions of sale apply to all orders placed by the Client with Moga BAGS:

Hereinafter referred to as Moga BAGS, and applicable to all sales contracts, including any ancillary service provision.

These general terms exclude any general or specific purchasing conditions of the Client unless explicitly accepted in writing by Moga BAGS. No deviation from these terms shall be allowed without written confirmation from Moga BAGS.

Unless proven otherwise, the Client acknowledges having received and read a copy of these general terms and conditions of sale.

These terms aim to define the contractual relationship between the seller and the buyer and the conditions applicable to any purchase made via the website or Facebook page, whether the buyer is a professional or a consumer. Purchasing a product through the site or page implies the buyer’s unconditional acceptance of these terms. The seller reserves the right to modify the terms at any time.


2. Products/Services Offered

The products or services offered are those listed in the catalog published on the seller’s website or page, each accompanied by a description. Products are described as precisely as possible.

However, if any errors or omissions occur in the descriptions, the seller shall not be held liable. Catalog photos are as accurate as possible.

Products are offered subject to stock availability. If items are unavailable, the seller will notify the buyer by email as soon as possible and offer the option to wait or cancel the unavailable items without charges.


3. Order

The parties are contractually bound after the following steps are duly completed:

  • The Client selects the desired product/service online;

  • The Client fills in an online form with their details and product information;

  • A summary page of the order is displayed;

  • The Client confirms that they have read and accepted the terms and proceeds with payment;

  • A confirmation page/email is sent acknowledging receipt of the order.

The contract is concluded once payment is received and validated. Confirmation is sent via email.

Moga BAGS reserves the right to suspend or reject an order in cases of:

  • Incomplete or incorrect order;

  • Incorrect personal data;

  • Non-payment;

  • Payment authorization refusal.

Products are offered subject to stock availability. Moga BAGS cannot be held responsible for delivery delays due to stock shortages.

Orders are final only once the price has been paid.

If a product is unavailable after order confirmation, Moga BAGS will inform the client and offer a replacement or refund via PayPal or bank account used for the order.


4. Price and Payment Conditions

All prices listed in Euros (€) include VAT.

Offers and prices are valid on the day they are viewed and may change without affecting confirmed orders.

Payment is due upon ordering for online purchases.

Delivery will occur only after payment is received by Moga BAGS.

Payments may be made by bank transfer, credit card via PayPal, or PayPal electronic payment.

An invoice showing VAT can be provided upon request.


5. Delivery

Minimum delivery time is 4 weeks for custom from order and payment receipt (currently within Belgium only).

Delivery time is mutually agreed upon but depends on stock availability. Partial deliveries may occur.

Events beyond control may delay delivery, including:

  • Force majeure;

  • Order anomalies (packaging, address, promotion dates, etc.);

  • Client’s failure to meet payment deadlines.

Delays in delivery do not entitle the Client to claim damages or cancel the order.

Delivery will only occur if the Client is up to date with obligations toward Moga BAGS.

In case of damage or missing items, the recipient must note it on the delivery slip and confirm with the carrier within 48 hours via registered letter. Clients may not destroy goods.

Hidden defects must be reported to the seller within 48 hours of discovery. Legal action must be taken within 15 days of discovering the defect.

Deliveries are made by Moga BAGS or authorized logistics partners.

Special logistics requests from the Client will be subject to a feasibility and cost study.


6. Right of Withdrawal and Returns

Under the law, consumers have 14 business days from the day after delivery to cancel their purchase without penalty or justification.

Within this time, the consumer must notify Moga BAGS by email and return the product at their own expense and risk to the seller’s administrative address.

Return shipping costs are the client’s responsibility. Moga BAGS will refund the client (excluding shipping costs) within two weeks of receiving the return.

Items must be returned in original packaging with protection. Damaged, incomplete, used, or opened items will not be refunded or exchanged.

7. Warranty

The Seller guarantees services are performed professionally and products are free from defects. The seller disclaims responsibility for hidden defects.

The seller is liable for conformity defects that exist at delivery and appear within two years, per Articles 1649 bis et seq. of the Civil Code.

The consumer must notify the seller within two months of noticing the defect. Legal action must be taken within one year and not less than the two-year warranty period.

The warranty does not cover misuse, normal wear, repairs by third parties or the Client, or lack of maintenance.

In all cases, the seller’s liability is limited to the sale price of the product/service.


8. Complaints

Except as noted in the previous article for consumers, complaints regarding service execution must be submitted via registered mail within 7 business days after service, with a detailed description of grievances.

Beyond this period, services are deemed definitively accepted.


9. Intellectual Property

Any reproduction or representation of our trademarks, in full or in part, without written consent is prohibited.

Any use of the brand, logo, or visuals must comply with the materials provided by Moga BAGS.

The concept “Moga BAGS” is the property of the company and officially copyrighted.

Any links (including hyperlinks) are strictly forbidden without written permission.


10. Personal Data

Moga BAGS complies with privacy laws when collecting and processing personal data. Access to your personal account is protected by a password you choose when creating your account.

Collected data includes the identity and contact details of the recipient. The legal basis for processing is contractual necessity.

With consent, Moga BAGS may use the data to send newsletters and promotional offers.

Data is retained only as long as necessary for its intended purpose, including legal and accounting requirements.

Moga BAGS does not sell or rent email or postal addresses or other personal data.

Clients have rights to access, correct, oppose, or delete their data by emailing: [email protected]


11. Cookies

Cookies facilitate navigation and measure site traffic. These are text files placed on your hard drive. Your browser likely accepts cookies by default, but this can be changed if desired.

When visiting our website, we collect and store visitor data such as domain name, IP address, time/date of access, and referring URLs. This is used to analyze site usage and improve functionality. This data is destroyed after a period. If you do not wish to share this data, do not browse our site.


12. Links

The site may contain links to external websites or resources. As we have no control over them, we are not responsible for their content or availability. We disclaim any liability for damages or losses arising from their use.


13. Jurisdiction

In case of a dispute regarding the interpretation or execution of the contract, the parties will attempt an amicable resolution.

The contract and these terms are subject to Belgian law.

Any dispute concerning validity, interpretation, or execution will be submitted to the exclusive jurisdiction of the courts of the Hainaut district.
